By accessing or using orbits8's website, mobile application, and trading platform ("Services"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you may not use our Services.

We reserve the right to modify these Terms at any time. Continued use of our Services after changes constitutes acceptance of the modified Terms.

2. Account Registration

To use our Services, you must create an account and provide accurate, complete, and current information. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Ensuring your account information remains up-to-date

You may only have one account. Multiple accounts are prohibited and may result in termination.

3. Verification and KYC

To comply with anti-money laundering (AML) and counter-terrorism financing (CTF) regulations, we require identity verification:

• Government-issued photo ID
• Proof of address (utility bill or bank statement)
• Source of funds information for large deposits
• Enhanced due diligence for high-volume traders

We may suspend accounts that fail to complete verification within specified timeframes.

4. Prohibited Activities

You agree not to engage in any prohibited activities, including but not limited to:

• Money laundering, terrorist financing, or other illegal activities
• Market manipulation, wash trading, or insider trading
• Using the platform for gambling or betting
• Attempting to hack, disrupt, or overload our systems
• Reverse engineering our software or platform
• Creating multiple accounts for abusive purposes
• Using automated scripts or bots without authorization
• Impersonating another person or entity

Violation of these terms may result in immediate account termination and legal action.

5. Trading Rules

When using our trading services, you agree to:

• Only place trades that you intend to execute
• Not manipulate order books or create artificial price movements
• Not use the platform for price discovery without intention to trade
• Comply with all position limits and trading restrictions
• Accept that all trades are final and irreversible

We monitor trading activity for suspicious patterns and may restrict accounts that violate these rules.

6. Deposits and Withdrawals

Deposits: All deposits must come from accounts in your name. Third-party deposits are prohibited. Deposits may be subject to minimum amounts and processing times.

Withdrawals: Withdrawals will only be sent to accounts in your name. We may hold withdrawals for security review (typically 24-72 hours). Withdrawal fees apply and are displayed before confirmation.

We reserve the right to reverse transactions that result from platform errors or unauthorized access.

7. Fees and Charges

Our fees are transparent and displayed in your account dashboard:

• Trading fees are charged at the time of each transaction
• Deposit and withdrawal fees vary by method
• Inactivity fees apply after 6 months of no login activity
• We may adjust fees with 30 days written notice

All fees are deducted directly from your account balance.

8. Intellectual Property

All content on our platform, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, and software, is the property of orbits8 or our licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any content without our express written permission.

9. User Content

You retain ownership of content you submit to our platform, including feedback, comments, and suggestions. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and distribute such content for any purpose.

You represent that you have all necessary rights to grant this license.

10. Account Suspension and Termination

We may suspend or terminate your account for any violation of these Terms, including but not limited to:

• Providing false or misleading information
• Engaging in prohibited activities
• Failure to complete verification
• Extended account inactivity (12+ months)
• Legal or regulatory requirements
• Security concerns or suspected unauthorized access

Upon termination, remaining funds will be returned after deducting outstanding fees.

11. Limitation of Liability

To the maximum extent permitted by law, orbits8 and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use our Services
• Any conduct or content of any third party on our Services
• Any content obtained from our Services
• Unauthorized access, use, or alteration of your transmissions or content

Our total liability shall not exceed the amount of fees paid by you to us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless orbits8 and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of our Services
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit to our platform

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where orbits8 is registered, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the relevant arbitration association.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
